WhatsApp End-to-End-encryption can be illegal in India,according to the Dot Rules which was issued in the year 2007,has a statement that a private company cannot use encryption more than 40 bits if they so do it can be illegal and they wanted to do it at any cost they have to submit the decrypting keys to government,But in this fact WhatsApp has encrypted in such a way that WhatsApp thereby cannot decrypt it and as by this they cannot submit the decrypting keys to the government and WhatsApp is using 256-bit encryption by default for its encryption and the permission by INDIAN government is for 40bits encryption by this manner it makes it illegal but the fact is that WhatsApp is not an ISP (Internet Service Provider) and neither it needs any DOT licences to offer its services in INDIA.

So it is not cleared that DOT rules will be applied to it or not if applied than WhatsApp chatting may be illegal.Last year the government floated a draft proporsal for the use of encryption in INDIA.As the Draft was very very bad and government refused it because of the the criticism,But there is much confusion about it.After the strong decision of End to End Encryption worldwide it make a default decision for all users.
